An Analysis of the War Powers Act of 1973

One of the hallmarks of a presidential and democratic society is the division of powers among the three main branches of government. This is called the principle of the separation of powers or the principle of checks and balances. This principle seeks to prevent the over concentration of authority in one person or group of persons that might lead to an error or abuse to the prejudice of the whole state. Austin Ranney (1995) once said that any concentration of powers in a single branch is tyrannical and only true separation of powers will protect the liberties of the people against the aggressions of government. (Austin Ranney, p. 240) The principle of separation of powers has always been criticized as impeding the enactment of bills and promoting efficiency in the running of the affairs of the government. It is because of this reason why some democratic countries have amended their constitutions and shifted to the parliamentary system. War Powers Act of 1973 A concrete example of the Principle of Separation of Power is the war powers which the US Constitution has entrusted to the Executive and the Legislative Branch. Under the United States Constitution, it may appear that the delineation of war power between the Legislative and Executive Branch is clear. The purpose is to make sure that no one branch of government will have the absolute prerogative in making all decisions in matters pertaining to war. Article 1 Section 8 of the United States Constitution clearly expresses that the Congress shall have the following powers: a) To declare War, grant letters of marque and reprisal, and make rules concerning captures on land and water; b) To raise and support armies, but no appropriation of money to that use shall be for a longer term than two years; c) to provide and maintain a navy; d) to make rules for the government and regulation of the land and naval Forces; e) to provide for the calling of the militia to execute the Laws of the Union, suppress insurrections and repel invasions; f) to provide for organizing, arming, and disciplining, the militia, and for governing such part of them as may be employed in the service of the United States, reserving to the states respectively, the appointment of the officers, and the authority of training the Militia according to the discipline prescribed by Congress. On the other hand, under Article II Sec. 2 of the United States Constitution the President shall have the following powers: a) The President shall be Commander in Chief of the army and navy of the United States, and of the militia of the several States; b) The president shall have power, by and with the advice and consent of the Senate, to make treaties, provided two thirds of the senators present concur. Based on these two provisions in the United States Constitution, the war powers appear to be clearly divided between the two main branches of government. Under these provisions, the President has the power to lead the armed forces in times of war and to make swift decisions on the field of battle. (â€Å"War and Treat Powers†) On the other hand, the Congress has the power to declare war and to appropriate huge amounts of dollars in support of the war effort. The clear division of powers between the two main branches, however, appear to be more apparent than real. In between these two powers lie a vacuum which the framers of the constitution failed to consider. For any other decisions that the US Constitution failed to anticipate, it appears that the President has complete freedom and absolute discretion to act. This is something which is abhorred by our constitution. Consider the Korean War in which the United States army was intensely involved. The Korean War began as a civil war which was fought from 1950–1953 on the Korean Peninsula. It began when North Korean attacked South Korea on June 25, 1950. (â€Å"Korean War†) Eventually China and the United States became involved in this conflict. Although it was called the Korean War, the United States preferred to call it the police action rather than a war in order to avoid the necessity of formal declaration of war by the Congress of the United States. The same thing happened during the Vietnam War or the Vietnam Conflict. This war lasted for 16 which began from 1959 to 1975. (â€Å"Vietnam War†) This involved the United States, its allies and the South Vietnam against Soviet Union, its allies and the People’s Republic of China and the North Vietnam. In this war, the U. S. deployed large numbers of troops to South Vietnam between 1954 and 1973. Some U. S. allies like the Philippines, Australa and New Zealand also sent their troops to aid the United States and South Vietnam. Similar to the Korean War, the United States was also intensely involved in this war without a formal declaration of war by Congress. These two major events in our history have triggered the enactment of the War Powers Act of 1973. It is worth stressing that based on our history Congress has formally declared war in only five conflicts – the War of 1812, the Mexican War, the Spanish-American War, World War I, and World War II – while U. S. presidents have committed armed forces to more than one hundred combat operations around the world. (Charles F. Williams, 2003) The purpose of this law is to provide for a limitation on the powers of the President to deploy United States troops into combat areas without the approval of the legislative branch. Congress aims to prevent the possibility that another Korean and Vietnam Wars may be repeated where the United States deployed its soldiers for battle without the formal declaration of war coming from the Congress. Section 2(a) of the said law is clear on this matter, it states that: â€Å"It is the purpose of this joint resolution to fulfill the intent of the framers of the Constitution of the United States and insure that the collective judgment of both the Congress and the President will apply to the introduction of United States Armed Forces into hostilities, or into situations where imminent involvement in hostilities is clearly indicate by the circumstances, and to the continued use of such forces in hostilities or in such situations. Under the said law, the president is required to consult Congress in every possible instance before introducing United States Armed Forces into hostilities or into situation where imminent involvement in hostilities is clearly indicated by the circumstances, and after every such introduction shall consult regularly with the Congress until United States Armed Forces are no longer engaged in hostilities or have been removed from such situations. The War Powers Act of 1973 also requires the President to submit within 48 hours to the Speaker of the House of Representatives and to the President pro tempore of the Senate a report, in writing, setting forth the circumstances necessitating the introduction of United States Armed Forces, the constitutional and legislative authority under which such introduction took place and the estimated scope and duration of the hostilities or involvement in case United States Armed forces are actually introduced for combat. The said law also requires the President to terminate within sixty calendar days after a report is submitted any use of United States Armed Forces unless the Congress has declared war or has enacted a specific authorization for such use of United States Armed Forces or has extended by law such sixty-day period or is physically unable to meet as a result of an armed attack upon the United States. The sixty-day period shall be extended for not more than an additional thirty days if the President determines and certifies to the Congress in writing that unavoidable military necessity respecting the safety of United States Armed Forces requires the continued use of such armed forces in the course of bringing about a prompt removal of such forces. The Congress by concurrent resolution is authorized at all times to order the withdrawal of US troops. Arguments against War Powers Act of 1973 One of the arguments raised against the enactment of the War Powers Act of 1973 is that it is an act of encroachment on the part of the Legislature of a territory which the US Constitution has delegated to the Executive Branch. It must be stressed that the President took his oath before he assumed his office that he will faithfully execute the Office of President of the United States, and he will to the best of his ability preserve and protect and defend the Constitution of the United States. The present statute significantly limits the powers of the president to act in times of war which have a serious effect on the performance of his obligation. Arguments In Favor of War Powers Act of 1973 On the other hand, some are in favor of the War Powers Act of 1973. They argue that the consultation and reporting requirements and the power of Congress to terminate the deployment of armed forces do not operate to limit the powers of the president. It merely serves to ensure that the constitutional mandate is observed. As envisioned by the United States Constitution, there shall always be two keys to start the engine of war running – the key given to the Congress and the key given to the President. Thus, the War Powers Act of 1973 does make Congress superior to the President, rather, it only highlights the supremacy of the United States Constitution. Conclusion I believe that the War Powers Act of 1973 is constitutional. Our history has shown that we cannot entrust to a single man the power to deploy United States troops to combat. In the past decade, all the past presidents, including our present president, has deployed hundreds of thousands of US soldiers to battle. This not only led to the death of countless soldiers but it has depleted our resources. The United States Constitution is still the highest law of the land and it is clearly manifested in the enactment of the War Powers Act of 1973.

S History Black Codes The Black Codes were laws in the United States after the Civil War with the intent of limiting the basic human rights and civil liberties of blacks as much as possible. Black Codes is used most often to refer to laws passed by Southern states at the end of the Civil War to control the labor, housing and other activities of newly-freed slaves.In Texas, the Eleventh Legislature produced these codes in 1866, right after the Civil War. The law reaffirmed the position that slaves and free blacks had held in Texas and was intended to make blacks work. The codes showed how stubborn white Texans were accepting blacks as equals and also their fears that freedmen would not work unless forced. The codes continued legal discrimination between whites and blacks.The legislature, when it amended the 1856 penal code, emphasized the difference between whites and blacks by defining all people with one-eighth or more black ancestry as pers ons of color, subject to special parts in the law. The black codes were enforced immediately after the American Civil War. Though different from state to state, they each set out to secure a steady supply of cheap labor, and continued to assume the weakness of the freed slaves. The black codes had their roots in the slave codes that had formerly been in effect.The idea behind slavery in America was that slaves were property, and, as such, they had few, if any, legal rights. The slave codes, in their many loosely-defined forms, were seen as effective tools against slave unrest, particularly as a protective method against revolts and runaways. Enforcement of slave codes also varied, but bodily punishment was widely and harshly used to great effect. These black codes were very unfair and lucky for African Americans are not used today. Written pages: 5 The Civil War caused many issues for American Society, from the physical separation of the southern states, to the issue of ending slavery, being the most well known, and for good reason. While the north wanted the slaves to be free, the south did not, which obviously caused Problems. This topic of free vs. slavery did not begin after the war started though, the government had dealt with many different cases and often the ended in favor of slavery.After the Civil War the issues with slavery still existed because of the creation of Black Codes, codes that basically forced the â€Å"free† men to report to a white employer or supervisor who decided what they could and could not do freely. These are just few of many reasons that the integration of freed black men, and men of color, took almost a century after the day they w ere legally released to truly have their freedom. One of the many reasons that the integration of the freed men into society was not more immediate was because of the stance of the national government before the war.The north may have not been slave states, but when it came to helping a slave in need, they were not going to be the ones to lend a hand. The Dred Scott case is a prime example of this stance. In this case a slaved argues that his owner moved from a slave state to a free state, thereby causing him to become a free citizen of society. This case was extremely controversial. While on one hand the slave made a point, the other hand caused the government to deny his request for freedom, without real rational reason.When the government’s stance changed and Abraham Lincoln became president, the newly elected president caused the country to go to war with itself because of his public stance on slavery. This tragic event caused the south to secede from the United States an d form their own government. Of course the sole issue of the south’s secession was not the loss of slavery, but also had an economic aspect as well. When the Civil War was over, it was quite obvious that the southern states still had a deep and powerful hatred for anyone of color.This hatred, as mentioned before, is the primary reason for the southern states creating the Black Codes. Not only did the Black Codes cause issues between the southern ex-slave owners and their freed slaves, but it also caused a great number of issues in the northern states. The northern states saw these Black Codes as an unfair and cruel way of bringing back slavery. Primarily because in the southern states state government, the white legislators saw no real reason to end the inequality between the white men, and the men of color (â€Å"Constitutional rights foundation,† 2011).Without establishing a new state of mind the governments in the southern states would continue to make these laws, l eaving the federal government unable to make any real changes to ensure the well being of the men of color. This only delayed the integration of the men of color into society even longer, because the relationship between the state governments and the national governments were too fragile at this point in time to make anything positive happen. In reviewing the South Carolina Black Codes, it is clear how biased and restricted the everyday lives of the freed men were.In order to integrate into society completely, the freed man would not only need to attempt to change the views of the white men around them, they were still required to follow the Black Codes. Rebellion could only get the freed men so far because they were not permitted to own anything that could be used as a weapon. The South Carolina Black Codes also prevented the migration of freed men to South Carolina without the approval of two South Carolina white men.These white men, known as freeholders, were essentially the peop le responsible for the freed men, also known as servants, that they approved. After that the Black Codes basically permit slavery to those who take on the responsibility for the freed men. The reason that the free slaves were not able to immediately integrate in society was the Continued existence of the Black Codes. The Black Codes only promoted the previously accepted view of superiority and resulted in lasting conflicts between the races for years.The immediate elimination of the Black Codes would have completely removed any political power that one race would have ad over the other, which in turn would have prevented the conflicts of pride and respect. An immediate overturning of the Black Codes would have also caused the issues of indirect slavery, and violations of rights given to all men by the Bill of Rights and the Constitution. Today, the country is encountering the biggest economic crisis, the war against Iraq seems to be endless, and the crime rates are increasing to a highly alarming level. As depressing as this current situation appears, the even more devastating part is that the juveniles have been partly responsible for the crime and violence all over the country. Juvenile delinquents are young people. To be more specific, they are individuals below the legal age or under eighteen who have been convicted of a crime. In some states, the legal age for criminal liability has been lowered down to 14 years old (Hill Hill, 2005). Criminal Justice System is a very complicated and diverse field, and the aspect concerning juvenile delinquency has always been on top of controversies and heated debates. These young people are in the early stages of their lives and as such, it is difficult to devise and implement the exact measure that will be necessary and effective for them to learn their lesson. Everybody knows that breaking the law and committing serious crime and violence are unthinkable; however, a more unbearable and heartbreaking thought would be finding out that the law offenders and crime doers are children who, at their very young age, are supposed to be blissfully unaware of the devastating aspect of being a grown-up. They should be in school studying, playing and enjoying their innocence (McCurley Snyder, 2004). Examining all the different angles of juvenile delinquency can be a very complex process, and as such, different measures and approaches are necessary. The observation made by many was that the plans and programs enacted focus too much in the offense, and they may have lost their perspective on the treatment. Some states lowered the age of accountability from juveniles to adults. The courts, on the other hand, created minimum sentences depending on the offense. The problem created in these situations lie in the application. These are offense-based strategies. They create an assumption that the youth who committed a crime should be dealt with no matter what. These laws completely disregard the age, level of maturity, individual differences, and the competence of the person in making judgments. For instance, in Virginia, New York, and other states, laws relating to juveniles have been adjusted to include young children who committed serious crimes to be tried as adults and not as juveniles (University of Pittsburgh, n. d. ). When asked about this new reform, these states simply stated that there are times when the child committed crimes in ways that are heinous and unthinkable, and as such, the acts cannot be perceived as the works of a child. Therefore, the court deemed it proper that they be tried and punished as adults (MoneyInstructor. com, 2009). Rehabilitation and not punishment should be the main aim of juvenile delinquency laws. The presumption is that adolescents are very fragile during their growing years. Thus, they should be treated with extreme care and sensitivity. In order to make an effective prevention plan, one must first understand the person’s main reason in being involved in these criminal activities in order for different methods and approaches in disciplining them to be enforced. The government has not given up hope in reaching out to these youngsters, so they made available community and residential treatments as well as non-residential and institutionalized treatments. A person will be placed by the court on probation when it becomes convinced that the child poses no harm or danger to himself and to the society. Probation is a supervised program commanded by the court of competent jurisdiction in instances wherein the offender is a youth which has been convicted of a criminal act. In this case, the person’s freedom is limited, and his or her activities are restricted and are under the custody of the Department of Juvenile Justice. It is mandated by the court that the youth should follow all the conditions and sanctions in connection with the offense (Florida Department of Juvenile Justice, 2005). Some of the conditions under which a youth is released for probation are being home on a specific time of the day upon the request of the probation officer, attending school, and obeying its rules and regulations constantly. The court may also order the youth to avoid going to a particular type of place and to avoid mingling with a group of people. As of 1999, statistics show that four out of ten juvenile delinquency cases or approximately more than one half were placed under probation (Elrod Ryder, 2005). Community-based correction and treatment pertains to the different kinds of overseeing, control, and support for the youth offenders. These plans and programs were organized because the government firmly believes that one of the efficient and effective ways to influence the young people to change their bad attitudes and behaviors and become a better person is to assist and give them responsibilities that belong to a normal person within a particular community (Elrod Ryder, 2005). It is important for the juvenile to be affiliated with a group. This will give him or her a chance to socialize and be acquainted with other people with whom he or she can relate to. This environment is especially set up and programmed for the children to feel as normal as possible and for them to be engaged in community-related activities. Making these youngsters feel that they are significant and accepted in the society will help speed up their rehabilitation. The government strongly supports the community treatment for juveniles because of the symbiotic relationship created. In this atmosphere, everybody has a role to play; therefore, no one would feel less important and insignificant (Streib Sametz, 2006). Restitution has also been made a part of the community treatment. In restitution, the offender gives either monetary payment or community service in proportion to the damages that the victim suffered. This is a way of reimbursing the victim for everything that he or she experienced because of the crime. The rationale behind this type of treatment is that rehabilitation in the lightest and mildest form may lead the offender to think about what he did. Putting a child in a penal establishment even for just a minor infraction would not rehabilitate him or her; it would ruin the child’s life and his or her perspective for the worst, thereby destroying his or her life (Streib Sametz, 2006). Community-based programs for correction and rehabilitation aim to achieve several objectives. These include but are not limited to sanctioning the youth offenders, assisting them in identifying themselves in relation to the community that they belong to, and helping them realize that being in this program is much better than being placed inside a penal establishment. There are times when they should realize the truth of their current situation because some of these young offenders resist being helped and would rather be put in an institution. Helping them see the possibilities and changes that may occur by reason of their cooperation in the community will help them gain a variety of new perspectives, and in some instances, this is an effective strategy (Elrod Ryder, 2005). Every treatment given is on a case-to-case basis depending on the situation. Thus, there is no treatment proven to be most effective for all juveniles. The community-based treatment generates different results. The test to measure whether or not a program worked is the recidivism rate. If the offender, after finishing the rehabilitation plan, never committed another crime again, that is only the time when the program can be declared as effective (Streib Sametz, 2006). There are also several pieces of evidence that prove that this program is less inexpensive than institutional-based programs. Other programs for youth offenders have been evaluated, and according to the findings, they do not produce great improvement as shown by subsequent acts of the offenders. The government was not surprised to a certain extent because the disparity between the community-based approach and other types of programs can be readily ascertained. Due to these results, some states are making a huge effort to shift their plan of action to community-based systems (Streib Sametz, 2006). There are many factors that come into play regarding the causes and effects of juvenile delinquency. The parents, the church, and the community greatly influence the upbringing of these children. In most cases, the root of the problem for these youth is lack of self-acceptance, guidance, and attention. The future of the country lies in the hands of these children, and if they mess up their present, they will have no future ahead of them. The juvenile justice system is continuing and struggling to attain its purpose in giving the youth a second chance at life because of that promising hope of a brighter tomorrow for the entire country.

According to Arieu (2007), there is strategic consistency when the actions of an organization are consistent with the expectations of management, and these in turn are with the market and the context. Strategic management is an ongoing process that evaluates and controls the business and the industries in which the company is involved; assesses its competitors and sets goals and strategies to meet all existing and potential competitors; and then reassesses each strategy annually or quarterly [i.e. regularly] to determine how it has been implemented and whether it has succeeded or needs replacement by a new strategy to meet changed circumstances, new technology, new competitors, a new economic environment., or a new social, financial, or political environment. Marketing action plan Placement and execution of required resources are financial, manpower, operational support, time, technology support Operating with a change in methods or with alteration in structure Distributing the specific tasks with responsibility or moulding specific jobs to individuals or teams. The process should be managed by a responsible team. This is to keep direct watch on result, comparison for betterment and best practices, cultivating the effectiveness of processes, calibrating and reducing the variations and setting the process as required. Introducing certain programs involves acquiring the requisition of resources: a necessity for developing the process, training documentation, process testing, and immolation with (and/or conversion from) difficult processes. As and when the strategy implementation processes, there have been so many problems arising such as human relations, the employee-communication. Such a time, marketing strategy is the biggest implementation problem usually involves, with emphasis on the appropriate timing of new products. An organization, with an effective management, should try to implement its plans without signalling this fact to its competitors.[3] In general terms, there are two main approaches, which are opposite but complement each other in some ways, to strategic management: The Industrial Organizational Approach based on economic theory deals with issues like competitive rivalry, resource allocation, economies of scale assumptions rationality, self discipline behaviour, profit maximization The Sociological Approach deals primarily with human interactions Information- and technology-driven strategy Peter Drucker had theorized the rise of the knowledge worker back in the 1950s. He described how fewer workers would be doing physical labour, and more would be applying their minds. In 1984, John Nesbitt theorized that the future would be driven largely by information: companies that managed information well could obtain an advantage, however the profitability of what he calls the information float (information that the company had and others desired) would all but disappear as inexpensive computers made information more accessible. Daniel Bell (1985) examined the sociological consequences of information technology, while Gloria Schuck and Shoshana Zuboff looked at psychological factors. Zuboff, in her five year study of eight pioneering corporations made the important distinction between automating technologies and info mating technologies. She studied the effect that both had on individual workers, managers, and organizational structures. She largely confirmed Peter Druckers predictions three decades earlier, about the importance of flexible decentralized structure, work teams, knowledge sharing, and the central role of the knowledge worker. Zuboff also detected a new basis for managerial authority, based not on position or hierarchy, but on knowledge (also predicted by Drucker) which she called participative management. In 1990, Peter Senge, who had collaborated with Arie de Geus at Dutch Shell, borrowed de Geus notion of the learning organization, expanded it, and popularized it. The underlying theory is that a companys ability to gather, analyze, and use information is a necessary requirement for business success in the information age. (See organizational learning.) In order to do this, Senge claimed that an organization would need to be structured such that:[75] People can continuously expand their capacity to learn and be productive, New patterns of thinking are nurtured, Collective aspirations are encouraged, and People are encouraged to see the whole picture together. Senge identified five disciplines of a learning organization. They are: Personal responsibility, self reliance, and mastery We accept that we are the masters of our own destiny. We make decisions and live with the consequences of them. When a problem needs to be fixed, or an opportunity exploited, we take the initiative to learn the required skills to get it done. Mental models We need to explore our personal mental models to understand the subtle effect they have on our behaviour. Shared vision The vision of where we want to be in the future is discussed and communicated to all. It provides guidance and energy for the journey ahead. Team learning We learn together in teams. This involves a shift from a spirit of advocacy to a spirit of enquiry. Systems thinking We look at the whole rather than the parts. This is what Senge calls the Fifth discipline. It is the glue that integrates the other four into a coherent strategy. For an alternative approach to the learning organization, see Garratt, B. (1987). Thomas A. Stewart, for example, uses the term intellectual capital to describe the investment an organization makes in knowledge. It is composed of human capital (the knowledge inside the heads of employees), customer capital (the knowledge inside the heads of customers that decide to buy from you), and structural capital (the knowledge that resides in the company itself). Manuel Castells, describes a network society characterized by: globalization, organizations structured as a network, instability of employment, and a social divide between those with access to information technology and those without. Geoffrey Moore (1991) and R. Frank and P. Cook[85] also detected a shift in the nature of competition. In industries with high technology content, technical standards become established and this gives the dominant firm a near monopoly. The same is true of networked industries in which interoperability requires compatibility between users. An example is word processor documents. Once a product has gained market dominance, other products, even far superior products, cannot compete. Moore showed how firms could attain this enviable position by using E.M. Rogers five stage adoption process and focusing on one group of customers at a time, using each group as a base for marketing to the next group. The most difficult step is making the transition between visionaries and pragmatists (See Crossing the Chasm). If successful a firm can create a bandwagon effect in which the momentum builds and your product becomes a de facto standard. Evans and Wurster describe how industries with a high information component are being transformed.[86] They cite Encartas demolition of the Encyclopedia Britannica (whose sales have plummeted 80% since their peak of $650 million in 1990). Encartas reign was speculated to be short-lived, eclipsed by collaborative encyclopedias like Wikipedia that can operate at very low marginal costs. Encartas service was subsequently turned into an on-line service and dropped at the end of 2009. Evans also mentions the music industry which is desperately looking for a new business model. The upstart information savvy firms, unburdened by cumbersome physical assets, are changing the competitive landscape, redefining market segments, and disintermediating some channels. One manifestation of this is personalized marketing. Information technology allows marketers to treat each individual as its own market, a market of one. Traditional ideas of market segments will no longer be relevant if personalized marketing is successful. The technology sector has provided some strategies directly. For example, from the software development industry agile software development provides a model for shared development processes. Access to information systems have allowed senior managers to take a much more comprehensive view of strategic management than ever before. The most notable of the comprehensive systems is the balanced scorecard approach developed in the early 1990s by Drs. Robert S. Kaplan (Harvard Business School) and David Norton (Kaplan, R. and Norton, D. 1992). It measures several factors financial, marketing, production, organizational development, and new product development in order to achieve a balanced perspective. Knowledge-driven strategy Most current approaches to business strategy focus on the mechanics of management e.g., Druckers operational strategies and as such are not true business strategy. In a post-industrial world these operationally focused business strategies hinge on conventional sources of advantage have essentially been eliminated: Scale used to be very important. But now, with access to capital and a global marketplace, scale is achievable by multiple organizations simultaneously. In many cases, it can literally be rented. Process improvement or best practices were once a favored source of advantage, but they were at best temporary, as they could be copied and adapted by competitors. Owning the customer had always been thought of as an important form of competitive advantage. Now, however, customer loyalty is far less important and difficult to maintain as new brands and products emerge all the time. In such a world, differentiation, as elicudated by Michael Porter, Botten and McManus is the only way to maintain economic or market superiority (i.e., comparative advantage) over competitors. A company must OWN the thing that differentiates it from competitors. Without IP ownership and protection, any product, process or scale advantage can be compromised or entirely lost. Competitors can copy them without fear of economic or legal consequences, thereby eliminating the advantage. The psychology of strategic management Several psychologists have conducted studies to determine the psychological patterns involved in strategic management. Typically senior managers have been asked how they go about making strategic decisions. A 1938 treatise by Chester Barnard, that was based on his own experience as a business executive, sees the process as informal, intuitive, non-routinized, and involving primarily oral, 2-way communications. Bernard says The process is the sensing of the organization as a whole and the total situation relevant to it. It transcends the capacity of merely intellectual methods, and the techniques of discriminating the factors of the situation. The terms pertinent to it are feeling, judgement, sense, proportion, balance, appropriateness. It is a matter of art rather than science. In 1973, Henry Mintzberg found that senior managers typically deal with unpredictable situations so they strategize in ad hoc, flexible, dynamic, and implicit ways. . He says, The job breeds adaptive information-manipulators who prefer the live concrete situation. The manager works in an environment of stimulous-response, and he develops in his work a clear preference for live action.[88] In 1982, John Kotter studied the daily activities of 15 executives and concluded that they spent most of their time developing and working a network of relationships from which they gained general insights and specific details to be used in making strategic decisions. They tended to use mental road maps rather than systematic planning techniques.[89] Daniel Isenbergs 1984 study of senior managers found that their decisions were highly intuitive. Executives often sensed what they were going to do before they could explain why.[90] He claimed in 1986 that one of the reasons for this is the complexity of strategic decisions and the resultant information uncertainty.[91] Shoshana Zuboff (1988) claims that information technology is widening the divide between senior managers (who typically make strategic decisions) and operational level managers (who typically make routine decisions). She claims that prior to the widespread use of computer systems, managers, even at the most senior level, engaged in both strategic decisions and routine administration, but as computers facilitated (She called it deskilled) routine processes, these activities were moved further down the hierarchy, leaving senior management free for strategic decions making. In 1977, Abraham Zaleznik identified a difference between leaders and managers. He describes leadershipleaders as visionaries who inspire. They care about substance. Whereas managers are claimed to care about process, plans, and form.[92] He also claimed in 1989 that the rise of the manager was the main factor that caused the decline of American business in the 1970s and 80s.The main difference between leader and manager is that, leader has followers and manager has subordinates. In capitalistic society leaders make decisions and manager usually follow or execute.[93] Lack of leadership is most damaging at the level of strategic management where it can paralyze an entire organization.[94] According to Corner, Kinichi, and Keats,[95] strategic decision making in organizations occurs at two levels: individual and aggregate. They have developed a model of parallel strategic decision making. The model identifies two parallel processes both of which involve getting attention, encoding information, storage and retrieval of information, strategic choice, strategic outcome, and feedback. The individual and organizational processes are not independent however. They interact at each stage of the process. FGF Signaling and Early Lung Development Essay -- Biology, Lung

Epithelial-mesenchymal interactions mediate organogenesis, which results from the activation of complex gene networks. Early respiratory development arises from the foregut endoderm and gives rise to tracheal and lung progenitor cells. Recent studies have linked fibroblast growth factor, Wnt, and other signaling pathways to the initial stages of lung development. Cells respond to signaling proteins mainly though transcription factors that ultimately determine cell fate and pattern formation. Gain and loss-of-function studies have facilitated the identification and functionality of molecular components as part of development. Fibroblast growth factor (FGF) signaling plays an important role in the regulatory network present in embryonic pulmonary development. FGF controls cell proliferation, differentiation and pattern formation; however, the interaction of FGF with other signaling pathways is still questioned by researchers. FGF-7 and FGF-10 are important for patterning and growth of the lung bud and are differentially regulated by FGF-1 and FGF-2. Research has shown FGF is an important factor in respiratory development as it regulates the expression of other signaling pathways. Said molecular events involving FGF signaling drive key phases of pulmonary development and thus the understanding of these key segmental mechanisms gives way to new knowledge of pathogenesis involving congenital anomalies, helping to develop innovative therapies to treat disease. Unless specifically mentioned, anything regarding expression patterns and developmental effects of morphogens, transcription and growth factors, or any other developmental factors effecting lung development are referenced from the murine lung. Accordingly, functional relevance... ...change, an extremely complicated process. The lung is an organ that contains a vast system of airways carefully constructed to achieve maximal surface area in a confined space. This helps to form an environment suitable for the bronchial and pulmonary vascular systems. These airways that grow out into the body, like a tree towards the sky, require careful guidance from many developmental factors such as transcriptional regulators, growth factors, morphogens and extra cellular matrix molecules. When mutations in the genes that control these factors occur, aberrations during lung development can arise and may lead to severe morbidity or mortality at birth due to respiratory failure. The FGF signaling pathway is one such signaling mechanism that is critical to proper lung formation, guiding branching morphogenesis and cellular proliferation of the developing lung.

As a young girl, I was not very interested in playing with baby dolls. I preferred playing with my many stuffed animals or the only doll I did like—Barbie. With my animals, usually I was rescuing them from some horrible disaster such as a flood or a forest fire. I was their heroic savior and benevolent protector. But with Barbie this was decidedly not the case. Sometimes my Barbie did normal Barbie things, such as get dressed up for an exciting date with Ken or go shopping with her little sister, Skipper. More often, however, I subjected Barbie to strange, sadistic acts of my imagination. Frequently Barbie, in her pink dune buggy, would have tragic head-on collisions with my brother’s dump truck, or the brakes would suddenly go out on her pink Barbie scooter, sending her careening off a steep mountain cliff. Barbie also had the unfortunate tendency to be sucked from her Barbie plane by her lovely long blonde hair while flying at 30,000 feet. Since in every other way I w as a normal child, psychoanalysts might interpret my play patterns with Barbie as childlike manifestation of women’s frustrations at the disparate images popular culture presents for women. Most women I know also experience this love/hate feeling towards Barbie and the mixed messages she represents, especially when their daughters start begging for Barbies of their own. While mothers do not want to encourage the unrealistic beauty expectations that Barbie represents, they also fondly remember Barbie as their own favorite toy. These many women, and their daughters, have made Barbie the most successful toy for girls since 1959, despite Barbie’s many contradictions. Sigumand Freud and Nietzsche: Personalities and The Mind There were two great minds in this century. One such mind was that of Sigmund Freud (1856-1939). In the year 1923 he created a new view of the mind. That view encompassed the idea we have split personalities and that each one have their own realm, their own tastes, their own principles upon which they are guided. He called these different personalities the id, ego, and super ego. Each of them are alive and well inside each of our unconscious minds, separate but yet inside the mind inhabiting one equal plane. Then there was Nietzsche (1844-1900) who formulated his own theories about the sub-conscious. His ideas were based on the fact that inside each and every one of us is a raging battle going on. This battle involves the two most basic parts of society, the artistic Dionysian and the intelligent Apollonian. Sometimes one being becomes more dominant than the other or they both share the same plane. Even though individually created, these theories could be intertwined, even used together. Thus it is the object of this paper to prove that the Freudian theory about the unconscious id, and ego are analogous to the idea on the Apollonian and Dionysian duality's presented by Nietzsche. "The division of the psychical into what is conscious and what is unconscious is the fundamental premise of psycho-analysis; and it alone makes it possible for psycho-analysis to understand the pathological processes in mental life..." (Freud, The Ego and the Id, 3). To say it another way, psycho-analysis cannot situate the essence of the psychial in consciousness, but is mandated to comply consciousness as a quality of the pyschial, which may be present (Freud, The Ego and the ID, 3). "...that what we call our ego behaves essentially passively in life, and that, as he expresses it, we are 'lived' by unknown and uncontrollable forces," (Groddeck, quoted from Gay, 635). Many, if not all of us have had impressions of the same, even though they may not have overwhelmed us to the isolation of all others, and we need to feel no hesitation in finding a place for Groddeck's discovery in the field of science. To take it into account by naming the entity which begins in the perception system. And then begins by being the 'ego,' and by following his [Groddeck's] system in identifying ... ...ersonality were named. The Apollonian, "...music had long been familiar to the Greeks as an Apollonian art , as a regular beat like that of waves lapping the shore, a plastic rhythm expressly developed for the portrayal of Apollonian conditions," (AD, in Jacobus, 556). That "plastic rhythm" described by Nietzsche is the cardinal groundwork for the theory of the Apollonian. Apollonian people are those who are totally based in the scientific world. They have no real imagination, no abstractness to their thinking. Whereas people who are wholly Dionysian are the opposite. These folk have no real basis in the real world. They are completely out of synch with reality because they think only in hypothetical thoughts. Hence the fact the most, if not all humans have a little of both in them. Most great scientists for instance are both Apollonian and Dionysian. They are mainly Apollinistic, due to the fact that they are clearly intelligent, which according to Nietzsche is the foundation for Apollonian thought, but they are also Dionysian. This can be said if you take Albert Einstein for an example. He is probably one of the most intelligent (and thus Apollonian) thinkers

In Emotional Intelligence, the only thing that I need to improve on is staying calm when speaking; I have a tendency to raise my voice and be overly intense. For Mindfulness, I was rated highly; I do posses the ability to maintain my full attention to the person and allow the person to speak before I do. Ethics was also rated highly, being able to keep in mind the situations of others. Competence was high, as well, I’m able to put aside my own differences in order to better understand others. 2. Discuss the differences and similarities between your interview results and your own self-assessment in Module 1: Discussion 2. How are people’s perceptions of your interpersonal effectiveness in alignment (or not) with your own? What surprised you? Honestly, I was not surprised by the results of the interview and my own self-assessment. I knew coming into the interview that I needed to work on some things, specifically, Emotional Intelligence. I’ve always had a temper when talking with someone and they are either not listening to me or not understanding where I’m coming from. It does seem that when I’m talking to someone I don’t really know, my Emotional Intelligence is in check. I’m able to tone down how I respond or act in unfamiliar territory when it comes to others. 3. How easy or hard was it for you to stay open-minded and non-defensive? Why? What did you have to do to stay open-minded and non-defensive? It was somewhat easy for me to stay open-minded and non-defensive because I was talking with someone I’m comfortable with. One thing I’ve learned is when you are faced with talking to someone you don’t necessarily agree with, it’s easy to put yourself in their shoes. Not getting so caught up in my feelings and ideas help me to maintain a leveled head. I have to remind myself that everyone is entitled to their opinions and ideals and I don’t have to like them but I do need to respect them. Having talked with someone I know did make me keeping all of that in mind, a little easier to do. 4. Why do you think you are being perceived as you are? Consider the perception process as outlined in Chapter 2 (i.e. selection, organization, interpretation, negotiation). For example, did your partner notice or â€Å"select† different behaviors than you expected? Or, did he/she think or â€Å"interpret† your behavior in ways that were different from what you intended? I think why I’m being perceived the way I am is because of my body language. The moment I folded my arms my partner knew I was becoming defensive. When I place my hand under my chin to rest my head, my partner assumed I was bored which was not the case at that time, I genuinely wanted to just hold my hand under my chin. Some perceptions that my partner saw and explained how they were feeling about it weren’t all accurate. My partner pointed out things that I didn’t realize I was doing and took it as disrespect but some habits I have are just that – habits. 5. Summarize 2 key insights from this assignment. What do you know now about your behavior and interpersonal effectiveness that you didn’t know before? There really wasn’t any behaviors and interpersonal effectiveness that I didn’t know already. This assignment did make some behaviors stand out more than others, such as, Emotional Intelligence. I’ve known I have a problem with remaining calm and not â€Å"wear my emotions on my sleeve† when having a conversation with someone and I don’t agree with what they’re saying. This assignment definitely pulled that out in full force and made me realize how often I do it. If anything that was a behavior that I didn’t notice that I do quite often in conversation. 6. Identify 2 actions you can take (i.e. new behaviors you can practice) that will immediately help you improve your interpersonal effectiveness. Be specific. One action I can take that will improve my interpersonal effectiveness is becoming a more active listener. Instead of just â€Å"waiting to speak† I can be present in that moment of conversation with someone and attentively listen. A second action I could practice would be to keep in mind Emotional Intelligence. Making sure I refrain from â€Å"wearing my emotions on my sleeve† and not get too involved in how things are said as much as what is being said. Listening with an open and clear mind will help me improve how I interact with others.

The Danger of Potent Ideology

It is inevitable that great men who wield great powers are bound to be misinterpreted. History reveals that this inevitability is true to the most influential men of our time, from the bible’s Jesus Christ to Germany’s Friedrich Nietzche, two opposites who share the same fate. The radical ideologies that both men promoted have become the basis of infamous acts and beliefs. For example, the fatal extremist belief that Christians abhor homosexuality is highly in contrast with the teachings of Jesus Christ, who advocated unconditional love and forgiveness. The Superhuman theory of Friedrich Nietzche, on the other hand, has been erroneously used to foster the idea that a particular race of man, or a particular individual, is superior to others. This Nietzche philosophy was speculated to be internalized by Adolf Hitler himself, who orchestrated the largest mass murder in the history of the world, simply because he believed in the superiority of the German race. Thus, we can see in the examples of Jesus Christ and of Friedrich Nietzsche, that when men rise above the conventions and to the challenges in their time, they are not only bound to become legends, but also misinterpreted leaders. Martin Luther King: A Force Misinterpreted In the United States of America, one potent influence suffers the same fate. Considered the leader of the free world; this man had so much power that he heightened a revolution and compelled a nation to change its laws. He is Martin Luther King, Jr. In his article entitled â€Å"Martin Luther King,† popular civil rights journalist Jack E. White describes King as, â€Å"the right man at the right time,† for in a revolution that needed a fearless leader, King became the perfectly accurate answer; the right man for the job. The nation at the time was ripe with protests against inequality. America then was a country that subscribed to the apartheid ideology;     segregation of individuals according to skin color was viewed appropriate. Race validated a person’s worth, and King fervently disagreed with this belief. He mobilized the African-American community into launching non-violent protest against discrimination, one of which is the 13-month boycott of the Montgomery bus lines in Alabama, in 1955. The popular and immortalized story of Rosa Parks, an African-American seamstress who refused to give up her bus seat for a Caucasian man prompted the boycott, but it was King who instigated and sustained the people’s resolve to protest. In 1957, King began organizing a network of African-American leaders and started facilitating non-violent protests in several communities. The awareness and significance of King’s cause heightened even more.   The most admirable trait King has demonstrated is his unwavering principle of non-violence, even when he himself had suffered through several acts of volatile violence, including the bombing of his home and unjust incarceration. Several communities and critics noted his incredible resilience and potent influence, and in the 1960s, he earned the recognition he so justly deserved. Time Magazine hailed him as its Person of the Year in 1963, and in the succeeding year, King was named as the 1964 Nobel Peace Prize laureate. However, King did not limit his cause to racial discrimination. He had far too much insight to narrow his perspective on one cause alone. Among the issues that he felt strongly about are the war in Vietnam and its accompanying factor, poverty.   By acting on these issues, Martin Luther King, Jr. became not just the leader of the African-American  demographic, but the most influential civil rights beacon who led the entire nation of America into a new light. Such a magnificent leader deserves a golden place in history, and Martin Luther King, Jr. is a figure truly well-placed not only in the annals of history, but in the hearts and minds of the American people as well. However, such a magnificent leader does not deserve a misinterpretation, and martin Luther King, Jr., is a figure highly misinterpreted. King’s impact today   extends only to African-American communities and engulfs only the issue of racial discrimination against African-Americans. Although this is a correct representation of King, it is a narrowed perspective of what he believed in, what he stood for, and what he fought and died for.  Ã‚   Jack E. White, in his article entitled, â€Å"Martin Luther King,† observes that: It is a testament to the greatness of Martin Luther King Jr. that nearly every major city in the U.S. has a street or school named after him. It is a measure of how sorely his achievements are misunderstood that most of them are located in black neighborhoods. Three decades after King was gunned down on a motel balcony in Memphis, Tenn., he is still regarded mainly as the black leader of a movement for black equality. That assessment, while accurate, is far too restrictive. For all King did to free blacks from the yoke of segregation, whites may owe him the greatest debt, for liberating them from the burden of America's centuries-old hypocrisy about race. Thus, we can clearly see that the United States of America owes him the label of â€Å"liberator of all,† instead of the restrictive label, â€Å"liberator of the black race.† The American nation we have  today would have a very different face if King had not step up to the demands of his time, if he had not heeded the cry of the American people. Martin Luther King, Jr. freed America from the bondage of racial hypocrisy, and yet he is denied such a distinction by assigning him only to one cause, and only to one community. The earlier premise that Martin Luther King, Jr., is a highly misinterpreted leader is once again emphasized here. As a matter of fact, King had the intention of leading a protest march against poverty, an American plight that was not unique to a certain race. From the cause of racial discrimination, he moved to the cause of fighting poverty. However, before he carried out his plans King was gunned down in a hotel balcony in 1968. Thus, his distinction should not be narrowed down merely to a single cause. His widow Coretta Scott King perfectly validated her husband’s life and her husband’s cause by organizing the â€Å"Martin Luther King Jr. Center for Non-Violent Social Change;† for it was the all-encompassing cause of social change that King believed in, stood for, fought and died for. Another misinterpretation of Martin Luther King, Jr. is the use of his principles and the use of his words to further racial issues grounded on a myopic perspectives.  Ã‚   One such movement that stands out from the rest, mainly because of its controversial nature, is the movement being led by Ward Connerly, an opponent of the government’s affirmative action policy. Connerly claims that his opposition against affirmative action is based on, and in parallel with, the advocacy of Martin Luther King, Jr. He asserts the erroneous interpretation that affirmative action is tantamount to racial discrimination. This claim is incredulous, since the affirmative action policy is aimed precisely to eradicate discrimination.   It is preposterous to conclude that the allocation of jobs minorities is equal with racial discrimination; it is even more preposterous that a magnificent leader such as King would even be associated with such an incredulous cause. In Respect to Martin Luther King’s Dream In these modern times, social change is a cry that resounds with so much fervor, and it is evident that so much has to be done to achieve the dream that Martin Luther King envisioned. King’s complex cause, social justice tied with economic justice, is a feat that requires internal and external changes within individuals, within communities, and the nation at large. It is worthy and important to note, however, that the United States of America has come a very long way indeed in terms of liberation from racial and social hypocrisy, and in this sense, we can say that King’s dream is slowly coming into reality. Racial discrimination, for instance, is now viewed as an abhorrent ideology, an unacceptable doctrine for the modern American. It is very much detested that whoever exhibits the slightest belief in it becomes an outcast in a nation of free thinkers, in a nation called the free world. The racist violence that was so apparent, so real, and so brutal in the past, prior to the emergence of Martin Luther King, Jr. and his civil rights cause, seems incredulous; it seems inconceivable that America has ever trodden such a path. The African-American race today, in fact, has earned a stellar place in America. Prominent names like talk show host Oprah Winfrey, professional golfer Tiger Woods, premier poet Maya Angelou, musicians Alicia Keys and Beyonce Knowles are influential figures in American society, admired by all races in America. Amusing Quotes.com lists this line from Chris Rock, a popular African-American comedian: â€Å"You know the world is going crazy when the best rapper is a white guy, and the best golfer is a black guy.† Though this statement is intended not to be taken seriously, we see a tinge of reality in it: the reversal of stereotyped roles between a black man and a white man is an indication that America has greatly changed its racial perception about the African-American race. This, however, is just a small parcel of achievement in the social change King aimed for. Because the nation is merely in the first step, racial equality, it is quite obvious that we do have a long way to go. To take up and succeed in tackling the Martin Luther King challenge, we have to go back to his words, and one effective guideline that stands out from among his speeches is his advice to live a complete life. Seattletimes.com discloses the manner in which a complete life may be achieved, according to King: And there are three dimensions of any complete life to which we can fitly give the words of this text: length, breadth, and height. (Yes) Now the length of life as we shall use it here is the inward concern for one’s own welfare. (Yes) In other words, it is that inward concern that causes one to push forward, to achieve his own goals and ambitions. (All right) The breadth of life as we shall use it here is the outward concern for the welfare of others. (All right) And the height of life is the upward reach for God. (All right) Now you got to have all three of these to have a complete life. Such wise, potent words may ring empty if it is not heeded, and the free world, in order to fulfill the noble dream of Martin Luther King, must begin acting on this quest for completion. True, racial equality is a cause forwarded by this magnificent leader; but to say that it is the only thing he fought for, is very much restrictive. This is the ripe time for America and the world to truly understand his cause, and to truly act upon it. Distillation Lab Report

Data and Conclusions: The purpose of this experiment was to learn how to use distillation and gas chromatography to separate and identify different compounds from a given mixture. There are several kinds of distillation methods. However, the method that we used in this experiment was fractional distillation. This method is used when trying to separate two different volatile compounds whose boiling points differ by 40-50Â °C or more.If the boiling points are too close, this method will not work because the two compounds will begin evaporating at close temperatures and will condense down to the receiving flasks at relatively the same times. This will not create an ideal separation. The apparatus used for this type of distillation is longer than that of a simple distillation experiment because this kind of apparatus creates more efficient separation. This happens because the fractional distillation apparatus is longer, and allows for several simple distillations to occur within the col umn itself to more accurately separate liquids.The inside of the column is said to have theoretical plates, or equilibrium stages that are created by the vapor and liquid stages of a compound that create this accuracy. The column must also be insulated with cotton and aluminum to prevent any heat loss that may lead to inaccurate temperature readings or even effect the evaporation of the different compounds. When heating the stillpot, flameless heating should be used along with a magnetic stirbar. This is important to control the temperature of the mixture and keep the heat smooth and constant.Heating the mixture too fast could result in no fractionation in the column and lead to no separation. Likewise, if the mixture is heated too slowly, the vapors might now make it all the way to the condenser, and the liquid will fall back into the stillpot. If the mixture is heated correctly and constantly, the vapors should condense through a condenser and into a receiving flask. This condense r should have water running through it at all times to keep it cool and keep the condensed vapor flowing down into the receiving flask.As a whole, the entire apparatus works perfectly for two different volatile liquids with 40-50Â °C boiling point differences because as the liquid with the lower boiling point is distilled out, the higher boiling point liquid will remain in the stillpot as the other is evaporating and distilled. Then, it will be able to evaporate later as the temperature rises, after the other has more than completely distilled out. As I conducted this portion of the experiment, I noticed that while taking the three fractions, fraction A filled up the full 15 mL and continued distilling through fraction B, and eventually stopped.Because of this, I hypothesized that all of fraction A and most of fraction B consisted of the low boiling point compound. As I raised the temperature of the hotplate, I was able to collect fraction C, and I predicted that it was composed of mostly the high boiling point liquid. To test this, the experiment called for the use of gas chromatography. The chromatography would not only show the relative concentrations of each compound in the fraction, but could also help confirm the identification of the compounds we thought were in the fractions based on the temperatures that each liquid boiled.Before trying to guess the correct compounds of the mixture, one must run each individual fraction through the machine to clearly see the composition of each. Gas chromatography works because as the liquid runs through the machine, its different components run through and exit at different times due to changes of temperatures that measure high and low boiling points. The machine records these using peaks of retention time that identify these different components. After obtaining this data, there was enough information to choose a reasonable match for each of the components.Once both the fractions and the guessed compound were mixed , the retention recordings should not differ in the number of peaks because ideally the compound mixed should have the same retention time as one of the other previous peaks. If the compounds were to differ in the number of peaks, then it shows that another compound must be present with different properties. As I conducted this portion of the experiment, I guessed cyclohexane for my low boiling point liquid and toluene or heptane for my high boiling point liquid based on the fractional distillation observations.For cyclohexane I mixed it with fraction A, since it predominantly consisted of my low boiling point liquid, and observed two peaks in my results. Therefore I concluded that cyclohexane was the low boiling point liquid. However, for the second liquid I guessed heptane first, and my results showed three peaks. Knowing that I had guessed wrong, I tested toluene mixed with my fraction C and only got two peaks. The high boiling point liquid proved to be toluene. In conclusion, my results all matched the main ideas and theories presented in the experiment.From my results I was able to figure out the composition of each of the compounds in the initial mixture and compare them to those of the rest of the class. My results only varied by 3. 18%. When using the two different methods of calculating the composition, the second method using the chromatography peaks was more accurate, and compared to the first method of assuming the ideal compositions, the results differed from the class average by over 10%. Based on the consistency of our class results using the second method, the two compounds proved to have been distilled using the proper method, and is reinforced by the use of gas chromatography.

Later in the day, the caregiver and the researchers would look back over the video recording of the session to allow the caregiver to give further comment on the morning routine. Using this methodology is useful because it allows the caregiver to incorporate emotions and feelings that were felt immediately after the event and logical thoughts that occurred after a period time into their responses, giving a fuller account of the effect of music on caregiving.
